Agreement to these terms
These Terms and Conditions ("Terms") govern your access to and use of the Percale platform and services operated by Percale Technologies ("Percale," "we," "our," or "us"). By accessing the platform, enrolling as a staff member, or entering into a pilot agreement with Percale, you agree to be bound by these Terms.
If you are using Percale on behalf of a hotel or organization, you represent that you have the authority to bind that organization to these Terms.
Percale Technologies is a trade name operated by a sole proprietor registered in New York. References to "Percale," "we," "our," or "us" throughout these Terms refer to that sole proprietorship operating under the Percale Technologies DBA.
The services
What Percale provides
Percale provides a hospitality operations platform that routes guest communications, surfaces suggested replies to hotel staff, and delivers operational notifications via email and optional SMS. The platform is designed to support hotel front desk teams and does not replace any existing property management system, messaging platform, or guest communication tool.
Percale is an assistive tool. All guest-facing communications remain the responsibility of the hotel operator and its staff. Percale does not send messages to guests autonomously and is not liable for the content of any communications sent by hotel staff using suggested replies generated by the platform.
The platform is provided on a pilot basis during initial engagements. Percale reserves the right to modify, suspend, or discontinue any aspect of the services at any time with reasonable notice to hotel operators.
Eligibility
Who may use Percale
The Percale platform is intended for use by hotel operators and their staff members. By using the platform, you represent that:
- You are at least 18 years of age
- You are authorized by your hotel or organization to enroll in and use the platform
- You will use the platform only for its intended operational purposes
- The information you provide during enrollment is accurate and complete
Accounts & access
Staff enrollment & access
Hotel staff members are enrolled in the Percale platform by completing the staff enrollment form at percale.io/staff-onboarding. Enrollment grants access to Percale notifications for the property specified at the time of enrollment.
You are responsible for ensuring that the information provided during enrollment remains accurate. If your role, property, or contact details change, please notify us at assist@percale.io so your enrollment record can be updated.
Percale reserves the right to suspend or revoke access for any staff member or hotel operator who violates these Terms or misuses the platform.
SMS messaging
SMS terms
SMS text message notifications are an optional feature of the Percale platform. By opting in to SMS notifications during enrollment, you agree to the following:
- You consent to receive operational SMS text messages from Percale via toll-free number related to account notifications and customer care for your hotel property
- Message frequency varies based on guest message volume at your property
- Message and data rates may apply depending on your mobile carrier plan
- You may opt out at any time by replying STOP to any message
- Reply HELP to any message for assistance
- SMS consent is not a condition of enrollment or employment
- Your mobile number will not be shared with third parties for marketing purposes
SMS opt-in is entirely voluntary. Staff members who do not opt in will continue to receive Percale notifications by email. Opting out of SMS at any time does not affect access to any other platform features.
Acceptable use
How you may use the platform
You agree to use the Percale platform only for its intended purpose of supporting hotel front desk operations. You agree not to:
- Use the platform to send unauthorized, unsolicited, or misleading communications to guests or staff
- Attempt to access, reverse-engineer, or interfere with any aspect of the platform's infrastructure
- Share access credentials or enrollment details with unauthorized parties
- Use suggested replies generated by the platform without appropriate staff review and approval
- Use the platform in any way that violates applicable laws or regulations
Intellectual property
Ownership
The Percale platform, including its software, design, content, and documentation, is the property of Percale Technologies and is protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the platform.
Hotel operators retain ownership of their own operational data, guest message content, and hotel-specific configuration information. By using the platform, you grant Percale a limited license to process this information for the sole purpose of delivering the platform's services.
Disclaimers
No warranties
The Percale platform is provided "as is" and "as available" without warranties of any kind, express or implied. Percale does not warrant that the platform will be uninterrupted, error-free, or that suggested replies generated by the platform will be accurate, complete, or appropriate for any specific guest interaction.
Hotel operators and staff remain solely responsible for all guest communications sent using the platform. Percale's suggested replies are intended as decision support tools and must be reviewed by a human staff member before use.
Limitation of liability
Limits on our liability
To the fullest extent permitted by applicable law, Percale Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to damages resulting from guest complaints, service interruptions, or reliance on suggested replies generated by the platform.
Percale's total liability to any hotel operator or staff member for any claims arising under these Terms shall not exceed the total fees paid by that operator to Percale in the three months preceding the claim, or $100, whichever is greater.
Termination
Ending access
Either party may terminate a pilot engagement at any time by providing written notice to the other party. Hotel operators may disable the Percale platform at any time using the kill switch controls provided, or by contacting assist@percale.io.
Upon termination, Percale will cease processing new messages for the relevant property. Data retention following termination is governed by our Privacy Policy.
Governing law
Jurisdiction
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of the State of New York or the federal courts located in the Southern District of New York, and you consent to the personal jurisdiction of such courts.
Changes
Updates to these terms
Percale may update these Terms from time to time. Material changes will be communicated to hotel operators via email at least 14 days before they take effect. Continued use of the platform following notice of changes constitutes acceptance of the updated Terms.
